Is Searching with a Detector Illegal?

Using a detector is seen by many people as a fun and enjoyable hobby. However, concerns about whether the law is being followed during this activity can make people hesitate to use a detector. It is therefore important to get more detailed information about the legality of using a detector.

Detectors are special equipment used to detect underground metals. Although the sale and use of these devices are generally considered legal, the truly prohibited and disputed matter is treasure excavation. Treasure excavations are subject to certain permits and legal procedures, and digs carried out without these permits are considered illegal. Therefore, detector owners using a detector in order to carry out treasure excavation may constitute a legal violation. For this reason, it is very important that your purpose in using a detector stays within legal limits.

In light of this information, being aware of the legal limits on detector use and using these devices only within the legal framework can be an important guide for people considering detecting as a hobby. Remembering that digs made to look for treasure require legal permission and that digs made without it are illegal is an important point for anyone who wants to start this hobby.

Although there is no legal penalty for researching with treasure detectors, there are some legal restrictions during these activities. In particular, it is forbidden for those searching, or for the vehicles of the people being searched, to carry tools used for digging, such as pickaxes, shovels and drilling equipment. Search activities may be carried out within the borders of the Republic of Türkiye, except on land declared by the state as protected (SİT) areas and in military zones.

The amendment made by Article 416 of Law No. 5728 dated 23 January 2008 did not remove the act of “unpermitted research” in the 3rd sentence of Article 74 of Law No. 2863 on the Protection of Cultural and Natural Assets from being a crime. On the contrary, such unpermitted research falls under the “unpermitted treasure research offence” in the 2nd paragraph of the new version of the law. In this context, individuals who will search for treasure must obtain the permits required by the relevant legislation and carry out their research within this legal framework. Treasure research carried out without legal permits is a crime under the law, and it is important to avoid such activities.

What Should Be Done to Search for Treasure with a Detector?

If you plan to hunt for treasure and to do so in line with legal standards, obtaining a permit is mandatory. This process takes place within the rules set by the Treasure Search Regulation. According to these rules, the places to be searched must be clearly defined and the necessary permits must be obtained by applying to the Ministry of Culture and Tourism.

Treasure hunters who obtain the relevant permit may use their detectors to search in the areas for which legal permission is given. However, carrying out any search activity in regions outside the scope of this permit is not legal. For this reason, searching for treasure outside the permitted areas is prohibited and this ban must be obeyed.

In light of this information, it is very important for people interested in treasure hunting to carry out this activity within the legal framework and with permits. Obtaining legal permits and searching within the limits of those permits ensures both personal safety and the protection of cultural heritage. Therefore, before starting treasure hunting, it is important to complete the necessary legal procedures fully and to examine carefully the details of the permits to be obtained from the Ministry of Culture and Tourism.

What Kinds of Metals Can Be Searched for with a Detector?

When you plan to search with a metal detector, you can discover many different types of metal such as gold, copper, bronze and silver. What matters most in this process is carrying out the metal search correctly and effectively and using your detector as efficiently as possible. When you search with the right settings, you can find jewellery, coins, metal objects and many other items.

Items found in searches with a detector generally belong to the finder if they are not historical artefacts. For this reason, one of the most important issues during a metal search is determining whether the objects found are historical artefacts. It is useful to take the possibility of historical artefacts into account while searching and to find a solution that suits your expectations.

In this context, when searching with a detector, it is important to assess the historical value of the findings and, if the finds are historical artefacts, to report this to the competent authorities. Protecting historical artefacts found while searching and contributing to the cultural heritage is both a legal and an ethical responsibility. In this way, searches made with a detector are carried out within both a legal and an ethical framework.
